Representative Matters

  • Tried and won a complete defense jury verdict for physician in a medical malpractice lawsuit with over $50 million at stake in damages claims. (tried with lead counsel Jeff Darling)

  • Obtained summary judgment for amusement ride operator in general negligence case involving accident and injury to a minor.  

  • Member of the trial team in two medical malpractice actions relating to the London Cardiac Stent Litigation. Successfully defended physician client in first and second bellwether trials.

  • Drafted winning summary judgment motion for employee and corporate client opposing enforcement of non-compete agreement.   

  • Successfully represented multiple healthcare clients before The Kentucky Board of Medical Licensure, Kentucky Board of Nursing, and Kentucky Board of Dentistry.

  • Drafted winning summary judgment motion for non-profit client in housing discrimination lawsuit regarding client’s alleged failure to grant reasonable accommodations and/or reasonable modifications.   

  • Lead counsel for Tennessee client who fell victim to fraud and misrepresentation by her realtor during the sale of an $820,000 farm to a high-profile purchaser.  Developed legal strategy against the realtor and formulated plan to salvage the sale.  Strategy resulted in pre-litigation settlement in favor of client and ability to salvage and negotiate favorable sale of farm for client.  

  • Successfully negotiated unique settlement of pre-litigation attorney malpractice claim that arose from probate representation wherein claimant’s damages exceeded insured’s policy limits by $200,000; total cost of settlement was the de minimis attorney fees incurred by claimant.

  • Authored winning appellate brief defending trial court’s entry of summary judgment based upon plaintiff’s failure to timely file within the statute of limitations under KRS 413.245 and lack of evidence that resulted from the trial court granting defendant’s motion to strike several hundred pages of untimely produced documents. Hous. Plus, Inc. v. Estate of Ross, No. 2011-CA-001453-MR, 2014 WL 2536864 (Ky. App. 2014).

Spare Time
Gary enjoys spending time with his family, cooking (mostly grilling), and reading.   He and his family worship at Providence Community Church.
