Representative Matters
July 2020, Jefferson County, Kentucky, Amica Mutual Insurance Company v. Frantinne Scott. Melissa Richardson and Colin Buckner successfully obtained a dismissal for their client, a private Louisville resident. Plaintiff filed a Complaint against her after someone she had recently purchased a vehicle from, but had not gained possession of, allowed their grandfather to operate the vehicle without her knowledge. The grandfather caused an accident and the Plaintiff attempted to sue the client because she owned the vehicle. Under Kentucky law, mere ownership of a vehicle is not enough to impute liability. There must be a special relationship between the owner and operator. Moreover, if the Plaintiff is attempting to make the claim a negligent entrustment matter, then the owner had to have knowledge the operator was reckless, inexperienced, careless, or intoxicated. The client in this matter did not know the seller’s grandfather, therefore, there was no special relationship or negligent entrustment. The client’s arguments were awarded a granted dismissal.

In his spare time, Colin enjoys playing golf, cheering for the Chicago Cubs, hanging out with loved ones and friends, and spending time on his farm with his dog, Molly.
